Access to Information  

The objective of Council's Access to Records Policy is to facilitate access by the public to information held by Council. Information is available from Council generally in the following ways:

  • Certain information is available informally via direct communication with Council officers. Enquiries in this regard should be directed at first instance to Council's Customer Service Team. See the Contact Us page for further details.
  • Individuals have a right to access the personal and health information held by Council about them under the Privacy & Personal Information Protection Act 1998; and the Health Records & Information Privacy Act 2002. Council's Privacy Management Plan is currently under review. For further details, please contact the Public Officer on 02 4350 5417.
  • Certain information is required to be made available to the public by law under the Local Government Act 1993, the Environmental Planning & Assessment Regulation 2000 and the State Records Act 1998. A list of these documents can be accessed here. Council also has a Summary of Affairs which lists all of the policy documents that are publicly available.
  • Information outside of the above categories can be accessed via application to the Public Officer under either section 12(6) of the Local Government Act 1993 (LGA) or the Freedom of Information Act 1989 (FOI). Applications under section 12(6) of the LGA can be made via the Access to Information Form. Applications under FOI can be made via the FOI Application Form.

Charges:

Generally, inspection of documents held by Council is free of charge. Where copies of any documents are required, reasonable copying charges will apply as per Council's Management Plan.

Applications for information concerning the personal affairs of the applicant under FOI attract a $30 application fee which covers up to 20 hours of processing time. Applications for other types of information under FOI are charged at $30 per hour.
