Development Control Plan Chapter 25
Objectives
This Development Control Plan aims to achieve the following:
- Provide a rear laneway and carparking.
- Provide for a maximum floor space ratio of 1:1.
- Provide for the orderly and economic development
of the land.
This Development Control Plan (DCP) may be amended
from time to time by Council. Proposed amendments are
required to be advertised and exhibited in draft form
and any submissions received must be considered by Council
before the amended plan is adopted. People using this
DCP should ensure that they have the current copy of
the plan, including any amendments. If in doubt, please
check with Council’s Customer Service Centre.
The Development Control Plan has been prepared pursuant
to Section 72 of the Environmental Planning and Assessment
Act, 1979 and Clause 24 of the Environmental Planning
and Assessment Act Regulations, 1980.
Land to which this plan applies:
This plan applies to Lots 280 and 281 DP 786453 and
Lots 29, 31 and 32 DP 17931 and Lot 2 DP 712945 Main
Road, Toukley between Summerside Street and Lakeview
Street.
Implementation:
In its determination of applications for the development
of the land to which this plan applies Council will
require:
- The dedication of the rear 12 metres of the property,
at no cost to Council for rear laneway and carparking
purposes.
- The construction of carparking at the rear of the
land in accordance with the map supporting this plan,
at no cost to Council.
- Where appropriate Council accept a cash contribution
towards future laneway construction where the location
of the proposed laneway renders construction at the
time of development impracticable.

- The maximum floor space ratio for development
is 1:1. The floor space ratio means the ratio
of the gross floor area of a building to the site
area.
- For the purpose of calculating the floor space
ratio for development the site area is to be taken
as that existing prior to dedication to Council
for the purpose of the rear laneway and carparking.
- Carparking will be required to be provided in accordance
with Council's Carparking Code. Council may require
a contribution for any deficiency in carparking that
is not provided on the land.
- When development or redevelopment occurs on Lots
280 PD 786453 and 32 DP 17931 Council will require
the dedication to Council at no cost to Council of
a splay corner 3 metres x 3 metres for sight distance
purposes to improve traffic safety.
Savings Provision
Any person making application for the development of
properties affected by this plan shall have due regard
for the provisions of Wyong Local Environmental Plan
1987 Urban Lands and of any other development codes
as are adopted by Council at the time of application.
Council reserves the right to vary the requirements
of the plan to a minor extent, only having regard to
the physical constraints of any given site or any improvements
erected thereon.
